The current legislative framework was adopted in 2008 and was named "New Legal Framework".

It is a package of measures aimed at improving market surveillance and increasing the quality of conformity assessments. It also clarifies the use of the CE mark and creates a series of measures to be used in the product legislation.

The legal acts composing the New Legal Framework (NLF) package were published in the OJEU L 218/82 on 13 August 2008. The NLF package is the modernization of the New Approach for marketing products to strengthen the application of the internal market legislation.

The package is composed by two regulations and one decision:

 

  • REGULATION (EU) 2019/515OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 19 March 2019 on the mutual recognition of goods lawfully marketed in another Member State and repealing Regulation (EC) No 764/2008
  • REGULATION (EU) 2019/1020OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 20 June 2019 on market surveillance and compliance of products and amending Directive 2004/42/EC and Regulations (EC) No 765/2008 and (EU) No 305/2011
  • REGULATION (EC) No 765/2008OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93
  • DECISION No 768/2008/ECOF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 9 July 2008 on a common framework for the marketing of products, and repealing Council Decision 93/465/EEC

 

Regulation (EU) 2019/515 and Regulation (EU) 2019/2020 did not need to be transposed into the national legislations of the MSs since they are regulations and not directives. Therefore they were directly applicable from 1 January 2010.

Decision No 768/2008/EC could be used immediately but to be operational needed to be implemented into the text of the products directives when revised.
